The present General Terms and Conditions of Sale (hereinafter the “GTC”) govern the contractual relations between, on the one hand, the company Boissons Shopping S.A., whose registered office is located at Zone Industrielle de la Veyre, 1806 St-Légier-Chiésaz - CHE-101.856.323, hereinafter referred to as “the Seller”,
And any natural or legal person purchasing products on amstein.ch, hereinafter referred to as “the Client”. The masculine form of the term “Client” applies indiscriminately to persons of all genders.
The present GTC apply without restriction or reservation to all sales concluded by the Seller with the Client, regardless of any clauses that may appear on the Client’s documents, in particular their general terms of purchase.
Article 1 – SCOPE OF APPLICATION
1.1 By placing an order on the website www.wineme.ch, the Client declares that they have read, understood and unreservedly accepted the present General Terms and Conditions of Sale in their entirety. They declare that they have the legal capacity to contract.
1.2 Registration on the website is reserved for adults with the capacity to perform legal acts. Registration requires complete, accurate and up-to-date data, which the Client is responsible for updating.
1.3 The sale of alcoholic beverages is prohibited to persons under 16 years of age for beer, wine and cider, and under 18 years of age for spirits. By registering, the Client confirms that they meet the legal age requirement.
Article 2 – SUBSCRIPTION
2.1 Subscriptions are payable in full at the time of ordering. They entitle the Client to receive a monthly box for the chosen period (3, 6 or 12 months). No automatic renewal is applied.
2.2 The consumer is entitled to revoke the contract by returning the ordered products to the sender within 14 days after receipt of the goods. No justification for returning the order is required. The revocation must be sent to order@wineme.ch in order to receive instructions. The Client’s exercise of the right of return results in a settlement, under which the services received under the sales contract must be returned by each party. Return costs are borne by the Client. The purchase price is immediately reimbursed to the Client upon receipt of the goods. The Seller reserves the right to deduct from the purchase price to be refunded, or to charge compensation, for possible deterioration, misuse or, by agreement, shipping costs. No deduction will be made from the refundable purchase price if the loss of value was caused by handling necessary to ascertain the nature, condition and functioning of the goods. The Seller may refuse reimbursement until the goods have been returned or until the Client has provided proof of return, whichever is earlier. No other method of termination is accepted.
2.3 In the event of early termination, no partial refund will be made. The initial amount paid also constitutes the maximum cancellation fee.
Article 3 – PRODUCTS
3.1 The products offered are described on the website www.wineme.ch. The texts and images are for information only and have no contractual value. The Seller accepts no liability for errors or omissions.
3.2 The products are of impeccable quality. Unless otherwise indicated, they are only guaranteed by the manufacturer.
3.3 No replacement will be made for corked bottles.
Article 4 – PRICES
4.1 The prices displayed are in Swiss francs (CHF), VAT included, excluding delivery charges.
4.2 The Seller may modify its prices at any time. The invoiced price is that in effect at the time of the order, confirmed by email.
4.3 Promotional discounts or loyalty points are automatically deducted at the time of order or may be used on future orders. Their validity is a maximum of 12 months.
4.4 Offers are valid as long as they appear on the website and while stocks last.
4.5 In the event of a manifest pricing error due to a technical malfunction, the Seller reserves the right to cancel the affected order.
Article 5 – ORDER
5.1 The order becomes final after confirmation by the Seller by email. The Seller reserves the right to cancel the order in the event of a pricing error or a technical bug resulting in an unintended price reduction.
5.2 In the event of insolvency, inaccurate information or other legitimate reasons, the Seller reserves the right to refuse or cancel an order.
Article 6 – PAYMENT
6.1 The accepted payment methods are: credit/debit card (Visa, MasterCard) or TWINT via our provider WORLDLINE. These options are valid only for Switzerland.
6.2 The Seller may require prepayment in the case of a first order or an outstanding balance.
Article 7 – SECURE PAYMENT AND DATA PROTECTION
7.1 Payments are processed via secure connections (HTTPS protocol). Payment data is encrypted and transmitted to WORLDLINE & PostFinance and is never accessible by the Seller.
7.2 The Seller complies with the Swiss Federal Act on Data Protection (nLPD). The Client may exercise their rights (access, rectification, deletion) by contacting order@wineme.ch.
7.3 The data collected is used solely for contract execution, invoicing and commercial communication. No data is transmitted to third parties, except in the case of legal obligations.
7.4 The website uses Google Analytics, a service provided by Google LLC. The use of cookies can be disabled by the Client via their browser settings. Certain features may then be limited.
Article 8 – DELIVERY
8.1 Delivery is made in Switzerland and Liechtenstein only, by Swiss Post or other carriers.
8.2 Delivery times are indicative (2 to 5 working days). Exceeding them does not entitle the Client to any compensation.
8.3 In the Client’s absence, the parcel may be deposited in front of the home. Risk is transferred to the Client at that moment. It is recommended to choose delivery with signature if the drop-off location is not secure.
8.4 If a product is unavailable, it will be refunded. No automatic restocking or compensation is provided.
Article 9 – PACKAGING AND RECYCLING
9.1 The disposal of bottles, cans and packaging is the responsibility of the Client.
Article 10 – DELIVERY COSTS
10.1 Delivery costs are borne by the Client and calculated according to weight and chosen delivery method. They are indicated in the basket before validation.
Article 11 – TRANSFER OF OWNERSHIP
11.1 Products remain the property of the Seller until full payment of the order.
Article 12 – RIGHT OF RETURN
12.1 The Client is required to check the condition of the goods upon receipt. Any claim (with photo) must be made within 48 hours by email to order@wineme.ch.
12.2 No return or refund is possible in the event of a Client order error, except by exceptional agreement with the Seller.
Article 13 – APPLICABLE LAW AND JURISDICTION
13.1 The present GTC are governed by Swiss law.
13.2 Any dispute shall be submitted to the jurisdiction of Boissons Shopping S.A. in St-Légier-Chiésaz (Switzerland).
Article 14 – AMENDMENTS TO THE GTC
14.1 The Seller reserves the right to amend the present GTC at any time. Only the GTC drafted in French are legally binding.
14.2 It is the Client’s responsibility to regularly consult the GTC in force on www.wineme.ch.
